Dumpster Rental Agreement

In this agreement, "COMPANY" means LPC Removal Service, which delivers and services the dumpster, and "CUSTOMER" means the person or business renting it.

Containers

Containers remain the property of the COMPANY. CUSTOMER may not modify a container, use it for anything other than the COMPANY's service, or move it. CUSTOMER may not hire anyone to crush, compact or burn anything inside the container. With 24 hours' notice, the COMPANY will move the container on the property for $200. CUSTOMER is responsible for loss of or damage to the container while it is in CUSTOMER's possession, must provide a suitable place for it, and must give the COMPANY access to it at reasonable times.

A $200 charge applies if (a) the COMPANY can't service the container because access wasn't provided and must return, or (b) the driver arrives for a requested pickup and CUSTOMER asks that the container stay. Debris may be loaded only to the top edge of the container. If a container is overfilled or unsafe to haul, the COMPANY may unload part of it on site.

Responsibility for the container

From delivery until pickup, the container is in CUSTOMER's possession and control. CUSTOMER agrees to hold the COMPANY harmless and indemnify it against claims for injury or property damage arising from CUSTOMER's possession or use of the container, including fire, theft, vandalism, graffiti and misuse. CUSTOMER must not overload the container or cause it to be overweight, and will pay any fine the COMPANY receives because of an overweight load.

Placement, property and access

The COMPANY isn't liable for damage to pavement, driveways, lawns or other surfaces from the container or the truck that services it. CUSTOMER must provide at least 15 feet of overhead clearance from wires and lines. If the driver believes a placement could damage property, the container or the truck, the driver may refuse it and suggest another spot.

The COMPANY places containers on private property, not in the street. CUSTOMER is responsible for any permit that may be required and for fines or move fees ($200) if a required permit wasn't obtained. The COMPANY isn't liable for delays caused by events beyond its control, such as weather, traffic, fires, floods or government action.

Weight

Each size includes a weight allowance (10 Yard Dumpster: 1.5 tons included; 15 Yard Dumpster: 2 tons included; 20 Yard Dumpster: 3 tons included). Weight over the allowance is billed at $225 per ton, prorated by the pound. If a load exceeds legal limits for the container or truck, CUSTOMER must remove enough material to bring it into compliance; otherwise the COMPANY may unload part of it on site.

What goes in

CUSTOMER warrants that nothing hazardous, toxic, radioactive or otherwise prohibited by law will be placed in the container, and will indemnify the COMPANY against all claims, costs, fines and damages caused by a breach of this warranty. This warranty survives the end of the agreement.

Items with fees (Massachusetts waste ban items): TVs / CRTs $50; Mattresses / box springs $100; Appliances with Freon (fridges, freezers, AC units, dehumidifiers) $50; Other appliances not placed on top of the load or at the back door $50; Tires $25. Propane tanks are not accepted. Prices may change and are posted on this website.

Yard waste (brush, grass, leaves) can't be mixed with other debris and is accepted only in a dumpster rented for yard waste. Asphalt, concrete, rock, brick and dirt may not be loaded without talking to the COMPANY first.

Hazardous materials

No liquids, batteries, paint, oil, toxic or hazardous materials, explosives, pressurized containers, or anything restricted by local, state or federal agencies.

Pickup and extra days

The container may be picked up at any time on day 14 of the rental unless other arrangements are made. After the rental period, each extra day is $10. If a load can't be picked up because it's too large, CUSTOMER must remove the excess, or the COMPANY may unload it on site to collect the container.

Charges

All charges, including overweight, item fees, extra days and the fees above, will be billed to CUSTOMER or charged to the card on file.
